Terms of Service

These Terms of Service ("Terms") govern your use of volflowtrades.com and your purchase or use of classes, workshops, educational materials, student accounts, and related services provided by VolFlow Trading Systems ("VolFlow," "we," "us," or "our"). By using the website, creating an account, or purchasing a class, you agree to these Terms.

Eligibility and accounts

You must be at least 18 years old and able to enter into a binding agreement to purchase a class or use a student account. You are responsible for providing accurate information, protecting your account access, and notifying us of suspected unauthorized use. You may not impersonate another person, interfere with the website, or use the services unlawfully.

Educational services only

VolFlow provides technology and financial-market education. We do not provide personalized investment, legal, tax, accounting, brokerage, or fiduciary advice. Nothing on the website or in a class is a recommendation to buy, sell, or hold a security or to use a particular strategy, broker, platform, or automated system.

Examples, demonstrations, backtests, simulated results, market commentary, and instructor experiences are educational illustrations. They do not guarantee future results. You are responsible for evaluating any system and deciding whether and how to use it.

Trading and technology risks

Trading involves substantial risk, including loss of principal. Algorithmic systems may fail because of software errors, incorrect rules, data problems, connectivity interruptions, API changes, order-handling issues, slippage, liquidity, market gaps, hardware failures, or human configuration mistakes. Paper trading and backtesting cannot reproduce every live-market condition. You should use independent judgment, appropriate safeguards, and only capital you can afford to lose.

Registration, payment, and seats

Prices, dates, locations, capacity, and minimum enrollment requirements are displayed during registration and may change before purchase. A seat is reserved only after payment is successfully completed and confirmed. Payment processing is provided by Stripe and may also involve payment-method providers offered through Stripe. You agree to provide accurate billing information and authorize the applicable charge.

If a displayed price or class detail is clearly erroneous, we may cancel the affected transaction and issue a refund rather than fulfill it on the erroneous terms.

Cancellations, transfers, and refunds

You may request a full refund by canceling at least 24 hours before the scheduled class start time. Cancellations made within 24 hours of the class, no-shows, and requests made after the class date are nonrefundable, except where required by law.

Classes generally require at least five students. If VolFlow cancels or does not run a class, you may transfer the payment to another available class or receive a full refund. VolFlow may reschedule a class when reasonably necessary and will offer an appropriate transfer or refund option.

Student responsibilities

You are responsible for bringing the required equipment and maintaining access to any third-party software or AI service identified in the class description. Keep brokerage credentials, API keys, passwords, and financial-account information private. Do not share those credentials with VolFlow, an instructor, another student, or through public chat.

You are responsible for complying with brokerage agreements, market-data licenses, platform rules, API limits, applicable laws, and restrictions governing your accounts. VolFlow does not guarantee that a broker, API, AI service, device, or account will be compatible or approved for live trading.

Intellectual property and permitted use

The website, course structure, written materials, graphics, software examples, and other VolFlow content are owned by VolFlow or used with permission and are protected by applicable intellectual-property laws. Subject to these Terms, you receive a limited, personal, nonexclusive, nontransferable license to use class materials for your own education and internal projects.

You may not resell, publish, distribute, record, reproduce, remove attribution from, or use VolFlow materials to create a competing course or commercial training product without written permission. Your independently created strategies, data, credentials, and code remain yours, subject to any third-party rights and licenses.

Third-party services

The services may integrate with or link to providers such as ChatGPT, Stripe, Google, Meta, brokerages, market-data providers, and software platforms. Those services are governed by separate terms and may change, become unavailable, or reject access. VolFlow does not control and is not responsible for third-party products, accounts, fees, decisions, outages, or security.

Acceptable use and suspension

You may not attempt to gain unauthorized access, probe or disrupt security, introduce harmful code, scrape or overload the service, misuse another person’s information, infringe rights, or use the website to facilitate unlawful or abusive activity. We may restrict or terminate access when reasonably necessary to protect the service, enforce these Terms, comply with law, or address nonpayment or misconduct.

Disclaimers

To the maximum extent permitted by law, the website, classes, and materials are provided “as is” and “as available.” VolFlow disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant profitability, uninterrupted access, error-free code, a particular educational outcome, or compatibility with any broker or platform. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, VolFlow and its owner, instructors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, trading losses, lost data, or business interruption arising from the services. VolFlow’s aggregate liability for a claim relating to a purchased class will not exceed the amount you paid VolFlow for the class giving rise to the claim. These limitations do not apply where prohibited by law.

Disputes and governing law

Before filing a claim, you agree to contact us and attempt in good faith to resolve the dispute informally. These Terms are governed by the laws of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes that cannot be resolved informally will be brought in the state or federal courts serving Fresno County, California, and you consent to their jurisdiction.

Changes and severability

We may update these Terms by posting a revised version and effective date. Changes apply prospectively unless otherwise stated. If a provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver.
